Terms of Service

By accessing or using the XtendWorks website, platform, or placement services, you agree to be bound by these Terms of Service. If you do not agree to all terms and conditions, you may not use our services.

XtendWorks acts as a specialized recruitment and talent placement platform, connecting vetted international professionals with enterprises worldwide. We facilitate introductions, assessments, and initial onboarding processes for technical, accounting, customer service, and healthcare roles.

Candidates. You agree that all information submitted (including resumes, skills, and identity) is accurate, current, and truthful. Misrepresentation of qualifications or professional history is grounds for immediate termination from the platform.

Clients. You agree to provide accurate job descriptions, maintain professional conduct during interviews, and fulfill all payment obligations as outlined in your specific partnership or service agreement with XtendWorks.

XtendWorks functions as a sourcing and matching agency. Unless explicitly stated in a separate Employer of Record (EOR) or contractor agreement, Candidates are not direct employees of XtendWorks. Clients are solely responsible for ensuring their engagement with Candidates complies with applicable labor laws, tax regulations, and contractor classifications.

Candidates agree to maintain the strict confidentiality of any proprietary information, trade secrets, or intellectual property (IP) disclosed by Clients during the interview process or subsequent placement. XtendWorks is not liable for any breach of confidentiality or IP infringement committed by a Candidate.

To the maximum extent permitted by law, XtendWorks shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the platform or the conduct of any Candidate or Client. We vet our professionals rigorously, but we do not guarantee the performance, uninterrupted tenure, or specific outcomes of any placed Candidate.

You agree to indemnify, defend, and hold harmless XtendWorks, its founders, partners, and affiliates from any claims, liabilities, damages, judgments, awards, losses, or expenses (including legal fees) arising out of your violation of these Terms, your use of the platform, or any dispute between a Candidate and a Client.

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
